Motonest - Terms of Service

These Terms of Service ("Terms") govern your use of the Motonest website and the Motonest mobile app (together, "Motonest" or "the service"). By using the service you accept these Terms. If you do not accept them, please do not use the service.
1. Who operates Motonest
Motonest is operated by Anerti Venture SRL, a company registered in Romania (tax ID 15435895), with its registered office at Str. Mihail Kogălniceanu 21, Sc. A, Et. 2, Ap. 5, Bistrița, jud. Bistrița-Năsăud, 420034, Romania. In these Terms, "we", "us" and "Motonest" mean Anerti Venture SRL.
2. Acceptance
By creating an account, downloading the app or browsing the website you agree to be bound by these Terms and by our Privacy Policy. If you use Motonest on behalf of an organisation, you confirm you are authorised to accept these Terms for it.
3. What Motonest is
Motonest helps riders discover motorcycle-friendly places — stays, food, workshops, fuel and more — and share the ones they find. Place information comes largely from the rider community and from public sources. Motonest is a discovery tool, not a booking or reservation platform, and we do not act as agent for the places listed.
4. Your account
You need an account for some features. Keep your login details to yourself and tell us promptly if you believe someone else has used your account. You are responsible for activity carried out through it. You must be at least 16 years old to create an account.
5. Content you submit
You keep ownership of the places, photos, notes and reviews you submit. By submitting them you grant Motonest a worldwide, non-exclusive, royalty-free licence to host, display, adapt and distribute that content as part of the service and to promote it. You confirm you have the rights to what you submit and that it does not infringe anyone else's rights.
6. Acceptable use
Do not submit false, misleading, offensive or unlawful content. Do not submit personal data about other people without their consent. Do not scrape, overload or attempt to gain unauthorised access to the service, and do not use it to advertise unrelated goods or services.
7. Moderation
Submissions are reviewed before they go live, and we may edit, refuse or remove any content that breaches these Terms or that we consider inaccurate. We may do so without prior notice. If you believe content about you or your business is wrong, write to us and we will look into it.
8. Adventure tours
Tours presented on the website are organised by Motonest or by partner operators. Prices, dates and itineraries shown are indicative and may change. A tour becomes binding only through a separate booking agreement, which carries its own terms, payment conditions and cancellation policy.
9. Third-party services and links
The service links to third parties — app stores, map providers, partner websites. We do not control them and are not responsible for their content or their terms. Downloads through Google Play or the Apple App Store are additionally subject to those stores' own terms.
10. Availability and changes
We work to keep Motonest available, but we do not guarantee uninterrupted access. Features may be added, changed or withdrawn. We may suspend the service for maintenance or for technical, legal or security reasons.
11. Liability
Motonest is provided "as is". Place details — opening hours, prices, facilities, road conditions — can be out of date or wrong. Always verify before you rely on them, and ride according to conditions and the law. To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the service. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, and your statutory consumer rights are unaffected.
12. Suspension and termination
You may stop using Motonest and delete your account at any time. We may suspend or close an account that breaches these Terms or that is used in a way that harms other riders or the service. Content you submitted may remain visible where other users have relied on it, unless you ask for its removal.
13. Changes to these terms
We may update these Terms as the service evolves. The effective date at the top shows when the current version came into force. If a change is significant, we will make it visible in the app or on this website. Continuing to use Motonest after a change means you accept the updated Terms.
14. Governing law
These Terms are governed by Romanian law, without prejudice to the mandatory consumer protections of your country of residence within the EU. Disputes should first be raised with us directly — most issues are resolved that way. EU consumers may also use the European Commission's online dispute resolution platform.
